End User License Agreement & Terms of Service

1. ACKNOWLEDGMENT & SCOPE OF LICENSE

This EULA is concluded between you ("End-User") and Brain Craft Limited ("Company"), and not with Apple, Inc. ("Apple") or Google, Inc. The Company, not Apple or Google, is solely responsible for the Sticker Maker application ("App") and its content.

The license granted to you for the App is limited to a non-transferable, non-exclusive license to use the App on any mobile device running iOS or Android that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions or Google Play Terms of Service.

2. USER-GENERATED CONTENT (UGC) & ZERO-TOLERANCE POLICY

The App allows users to create, upload, publish, and share user-generated content, including stickers, graphics, titles, and comments ("UGC").

A. Zero-Tolerance for Objectionable Content

Brain Craft Limited maintains a strict ZERO-TOLERANCE POLICY toward objectionable, abusive, or unlawful content and behavior. You agree that you will NOT create, upload, post, share, or transmit any UGC that:

• Is sexually explicit, nude, pornographic, or erotic.
• Promotes hate speech, racism, discrimination, harassment, bullying, or violence against individuals or groups.
• Is defamatory, libelous, threatening, or vulgar.
• Depicts or encourages self-harm, dangerous activities, or criminal acts.
• Infringes upon any third-party intellectual property rights, including copyrights, trademarks, or publicity rights.
• Violates the privacy or personal rights of any person without their explicit consent.

B. Content Moderation & Immediate Action

• Pre-Screening & Automated Filtering: We utilize automated content filtering and manual moderation to detect and remove objectionable content.
• Enforcement & Account Termination: Any user who posts content that violates this Zero-Tolerance Policy will have their content removed immediately and will face immediate account termination and a permanent ban from the Service without prior notice.

C. User Reporting & Blocking Tools

• Reporting: You can flag or report any objectionable UGC, AI content, or user profile directly within the App using the built-in "Report" button. All reports are reviewed, and appropriate action is taken within 24 hours.
• Blocking: You can block any user directly within the App using the "Block" feature. Blocking immediately hides all content created by that user from your view.

3. AI-GENERATED CONTENT & GOOGLE GEMINI INTEGRATION

The App features artificial intelligence tools powered by Google Gemini that allow you to generate custom stickers using text prompts and uploaded photos. By using AI features, you agree to the following terms:

A. Prompt Moderation & Prohibited Inputs

• All text prompts and uploaded images are subjected to automated safety filtering prior to processing.
• You agree not to input prompts or upload content designed to bypass safety guardrails ("jailbreaking"), or to generate content depicting nude/sexually explicit imagery, graphic violence, hate speech, illegal acts, or third-party intellectual property/trademarks without authorization.
• Repeated attempts to bypass AI safety filters will result in immediate suspension or termination of your account.

B. AI Output Disclaimer

• Experimental Nature: AI models produce results based on algorithmic processing. Brain Craft Limited does not guarantee that AI-generated stickers will be accurate, complete, unique, or error-free.
• No IP Infringement Warranty: You acknowledge that AI-generated content is created stochastically. Brain Craft Limited makes no representation or warranty that any AI-generated sticker is non-infringing on third-party copyrights, trademarks, or publicity rights, or eligible for legal copyright protection in your jurisdiction.

C. Ownership and Licensing of AI Outputs

• To the maximum extent permitted by applicable law, you hold the rights to use the AI-generated stickers created through your account, subject to these Terms and Google’s Generative AI Terms of Service.
• By generating, saving, or publishing AI stickers within the App, you grant Brain Craft Limited a perpetual, worldwide, non-exclusive, royalty-free license to host, store, display, and distribute those AI-generated stickers in connection with operating and promoting the Service.

4. INTELLECTUAL PROPERTY RIGHTS & UGC LICENSE

• Your Content: You retain ownership of the original images and content you create. However, by publishing UGC publicly within the App, you grant Brain Craft Limited a worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to host, store, display, reproduce, and distribute your UGC in connection with the operation of the Service.
• Company Intellectual Property: All software, design, app UI, source code, graphics, trademarks, and branding are the exclusive property of Brain Craft Limited.

5. COPYRIGHT INFRINGEMENT (DMCA TAKEDOWN)

If you believe that any content in the App infringes your copyright or intellectual property rights, please submit a written notice to: Email: support@braincraftapps.com

Your notice must include: (a) description of the copyrighted work; (b) location/sticker pack name of the infringing material; and (c) your full contact information.

6. MAINTENANCE AND SUPPORT

Brain Craft Limited is solely responsible for providing maintenance and support services for the App. Apple and Google have no obligation whatsoever to furnish any maintenance and support services with respect to the App.

7. NO WARRANTY & LIMITATION OF LIABILITY

• Warranty Disclaimer: The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, and Apple/Google will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple/Google will have no other warranty obligation whatsoever with respect to the App.
• Product Claims: Brain Craft Limited, not Apple or Google, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including product liability claims, regulatory compliance, and consumer protection claims.
• Limitation of Liability: Brain Craft Limited shall not be liable for any indirect, incidental, or consequential damages resulting from your use of or inability to use the Service.

8. LEGAL COMPLIANCE

You represent and warrant that:

1. You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
2. You are not listed on any U.S. Government list of prohibited or restricted parties.

9. THIRD-PARTY BENEFICIARY

You and Brain Craft Limited acknowledge and agree that Apple, and Apple’s subsidiaries, as well as Google, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple/Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Brain Craft Limited is registered, without regard to its conflict of law provisions.
